Terms of Service

1. Who you are contracting with
These Terms of Service ("Terms") form a binding agreement between you and Flexistore("we", "us", "our"), the provider of the Tidely booking service (the "Service").
2. Acceptance
By creating an account or continuing to use the Service, you agree to these Terms. If you are using the Service on behalf of an organisation, you represent that you have authority to bind it.
3. The Service
Flexistore provides Tidely, an online booking platform that lets businesses publish availability and accept appointments. We grant you a limited, non-exclusive, non-transferable right to use the Service within your selected plan.
4. Acceptable use
You must not:
- Use the Service unlawfully or for fraud, spam, or abuse.
- Infringe the intellectual property or privacy rights of others.
- Interfere with the security or integrity of the Service (malware, scraping, probing, circumventing limits).
- Reverse engineer, resell, or redistribute the Service.
5. Account responsibility
You are responsible for keeping your credentials confidential and for all activity under your account. You agree to provide accurate information and to keep it up to date.
6. Intellectual property
We retain ownership of the Service, including all software, documentation, and branding. You retain ownership of content you upload; you grant us a limited licence to host and process it solely to provide the Service.
7. Payments and subscriptions
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms. Subscriptions renew automatically until cancelled.

9. Service availability
We aim to keep the Service available but do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law, we disclaim all implied warranties.
10. Suspension and termination
We may suspend or terminate your access for material breach, non-payment, security or fraud risk, or repeated policy violations. On termination, your right to use the Service ends; we will provide a reasonable export window where feasible before deleting data.
11. Liability
To the fullest extent permitted by law, our aggregate liability is capped at the fees you paid in the 12 months prior to the event giving rise to the claim. We exclude liability for indirect or consequential damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability that cannot lawfully be excluded.
12. Indemnity
You agree to indemnify Flexistore against claims arising from your content, your unlawful use of the Service, or your breach of these Terms.
13. Governing law
These Terms are governed by the laws of the jurisdiction in which Flexistore is established. Disputes will be resolved in the competent courts of that jurisdiction.
14. Changes
We may update these Terms from time to time. Material changes will be communicated through the Service.
